Opinions of Yunnan Provincial People’s Government on further improving the service for migrant workers

The people’s governments of all prefectures and cities, the Administrative Committee of Central Yunnan Industrial New District, and the provincial committees, offices, departments and bureaus:

In order to implement the spirit of the State Council’s Opinions on Further Improving the Service for Migrant Workers (Guo Fa [2014] No.40), do a good job in serving migrant workers in the new period, effectively solve the outstanding problems faced by migrant workers, and promote the urbanization of migrant workers in an orderly manner, combined with the actual situation in our province, we hereby put forward the following opinions:

First, to further improve the overall requirements for the service of migrant workers

(1) great significance. Since the publication of "Several Opinions of the State Council on Solving the Problem of Migrant Workers" (Guo Fa [2006] No.5) in 2006, governments at all levels in our province have conscientiously implemented the deployment of the State Council, strengthened overall coordination, improved policies and measures, improved working mechanism, highlighted system construction and strengthened public services, and achieved remarkable results in serving migrant workers. However, at present, the employment stability of migrant workers is not strong, and the labor security rights and interests are still violated from time to time. The rate of participating in urban social insurance is not high, the scope of enjoying urban basic public services is narrow, and there are still many difficulties in settling down in cities and towns. The task of fundamentally solving the contradictions and problems of migrant workers is still very arduous. It is an urgent need to accelerate the transformation of the economic development mode of our province, an important content to promote the integration of urban and rural areas, and an important measure to comprehensively promote the rule of law and build Yunnan under the rule of law. All localities and relevant departments should fully understand the great significance of further improving the service for migrant workers, make overall plans and take various measures simultaneously in accordance with the State Council’s work arrangements, and pay close attention to implementation, and constantly create a new situation in the service for migrant workers in our province.

(2) guiding ideology. Guided by Deng Xiaoping Theory, Theory of Three Represents and Scientific Outlook on Development, we will fully implement the spirit of the 18th National Congress of the Communist Party of China, the Third and Fourth Plenary Sessions of the 18th Central Committee, the Central Urbanization Work Conference and the decision-making arrangements of the provincial party committee and government, actively explore the road of agricultural labor transfer with Yunnan characteristics in accordance with the requirements of the simultaneous development of industrialization, informationization, new urbanization and agricultural modernization, continuously strengthen employment and entrepreneurship services for migrant workers, and safeguard their legitimate rights and interests according to law. Promote migrant workers to gradually enjoy basic public services in cities and towns on an equal footing, focus on promoting the social integration of migrant workers, and promote and gradually realize the citizenization of migrant workers with conditions and willingness.

(3) Overall objectives. By 2020, the total amount of transferred agricultural labor will increase steadily, and 3 million migrant workers will be organized to participate in various trainings. The overall quality of migrant workers will be significantly improved, their working conditions will be significantly improved, their wages will basically increase without arrears, and they will participate in full coverage of social insurance. Efforts will be made to realize that permanent migrant workers and their accompanying families can also enjoy basic public services in cities and towns, basically realize the conditional and willing migrant workers to settle in cities and towns, and actively, steadily and gradually promote the citizenization of migrant workers.

Second, strengthen the employment and entrepreneurship services for migrant workers

(4) Strengthen the vocational training of migrant workers. Make overall plans for the training of migrant workers and the annual training plan, and the relevant departments shall organize the implementation according to the division of labor. Efforts will be made to build a lifelong vocational training system for migrant workers, to provide employment skills training for rural migrant workers, to provide labor preparation training for rural junior and senior high school graduates who have not entered higher education, to provide on-the-job skills upgrading training for migrant workers, and to provide high-skilled personnel training for migrant workers with intermediate or above vocational skills. Increase investment in training funds and implement the training subsidy policy. According to the demand of the employment market and the adjustment of industrial structure, we will focus on order-based training, orientation training, and fixed-position training for enterprises, determine the training occupation (type of work) for the market, and form a mechanism in which training institutions compete on an equal footing, migrant workers participate in training independently, and the government purchases services. Encourage enterprises to organize migrant workers to carry out training, and give enterprises training subsidies in accordance with relevant regulations. Encourage vocational colleges and technical colleges to further promote school-enterprise cooperation and build a number of training bases for migrant workers. Explore and carry out characteristic vocational training based on Yunnan folk crafts and traditional national skills, and build a brand of vocational training for migrant workers in Yunnan. (5) Actively develop vocational education for the newly growing rural labor force. Efforts should be made to realize that all rural junior high school graduates who have not been promoted to ordinary high schools and colleges and universities can receive vocational education. We will fully implement the tuition-free policy for rural students in secondary vocational education and the financial assistance policy for students with financial difficulties. Strengthen the main responsibility of governments at all levels and the administrative committee of Central Yunnan Industrial New Area to develop vocational education and technical education, encourage remote areas and ethnic areas in our province to rebuild and expand vocational colleges or technical colleges that meet the standards and mainly recruit students from rural areas according to needs, and support states and cities that do not have vocational colleges or technical colleges to establish vocational colleges or technical colleges that recruit students from rural areas according to local conditions. Integrate existing vocational education and training resources, strengthen the construction of teachers and vocational education training bases, innovate school-running models, reform teaching methods, and improve school-running quality. Actively promote the dual-certificate system for academic certificates and vocational qualification certificates. (six) improve and implement the employment and entrepreneurship policy for migrant workers. Further clean up discriminatory provisions such as household registration restrictions on the employment of migrant workers, and ensure the equal employment rights of urban and rural workers. We will improve the equal public employment service system between urban and rural areas, and provide targeted public employment services such as policy consultation, career guidance and career introduction for migrant workers. Actively and orderly undertake industrial transfer, and attract migrant workers to transfer employment nearby. Accelerate the development of service industry and plateau agriculture, attach importance to the development of labor-intensive industries, and vigorously develop jobs suitable for migrant workers. We will build farmers’ markets and catering stalls with reduced or exempted charges to meet the living needs of citizens and promote the employment of migrant workers. Strengthen the labor docking of migrant workers’ export and import places, and the export places can set up service stations in the import places where local migrant workers are relatively concentrated. Further strengthen the construction of rural labor transfer and employment demonstration counties. We will continue to improve the support system for migrant workers’ entrepreneurship, and use financial support, venture capital guidance and entrepreneurship training, policy-oriented financial services, small secured loans and interest subsidies, production and business premises and business incubation bases to promote migrant workers’ entrepreneurship. (seven) to support the development of Yunnan characteristic labor brand and promote employment. Fully tap the potential of local advantageous industries, traditional ethnic and folk crafts, and tourism resources to attract migrant workers’ employment, and explore policies and measures to support the development of migrant workers’ labor brand with Yunnan characteristics. Support and encourage qualified areas to establish special support funds, vigorously guide, support and cultivate a number of migrant workers’ labor brands with Yunnan national cultural characteristics, high visibility and comprehensive competitiveness, and gradually form a mechanism to promote the employment of migrant workers with labor brands, promote industrial development with employment, and improve the quality of labor brands with industrial development, and give play to the positive role of labor brands in promoting the stable employment and high-quality employment of migrant workers. (eight) vigorously develop the family service industry to promote the employment of migrant workers. Establish and improve the coordination mechanism for developing family service industry at all levels to promote employment, and strengthen overall coordination and work guidance. Focusing on the development of domestic service, aged care service, community care service and patient care service, we will formulate policies and measures to encourage and support the family service industry in our province to accelerate its development and expand employment. Study and formulate service standards for various formats of family services and promote the construction of service standardization. Encourage and guide migrant workers to find jobs and start businesses in the family service industry. Strengthen the construction of family service industry associations and give support in terms of start-up funds, office space and staffing. Third, safeguard the rights and interests of migrant workers’ labor security according to law

(nine) standardize the management of migrant workers’ labor and employment. Guide and urge employers and migrant workers to generally sign and perform labor contracts according to law. Carry out the model text of "Labor Contract for Migrant Workers in Yunnan Province" among migrant workers with high mobility, strong seasonality and short time. Standardize labor dispatch and employment according to law, and clean up illegal contracting and subcontracting in the construction field. Improve the employment policies and labor standards that adapt to the characteristics of domestic service. Strengthening the training of operators of non-public enterprises is focused on the labor contract law for operators of small and micro enterprises. (ten) to protect the legitimate rights and interests of migrant workers’ labor remuneration. We will fully implement the Provisions on the Guarantee of Wage Payment for Migrant Workers in Yunnan Province, and further implement the wage guarantee for migrant workers, the wage reserve for migrant workers, and the government’s emergency working capital system. Improve and implement the overall responsibility system of general contracting enterprises for the wage payment of migrant workers in contracted construction projects, the system of controlling malicious wage arrears through labor security supervision and law enforcement and criminal justice linkage, and the overall responsibility system of governments at all levels (real-name registration system Industrial New District Management Committee) to solve the problem of wage arrears, and promote’s wage payment bank card. Implement the principle of equal pay for equal work for migrant workers and urban workers in their own units. (eleven) to promote migrant workers to participate in social insurance. Implement the "National Insurance Registration Plan" and promote the continuous participation of migrant workers in various social insurances according to law. Migrant workers who have established stable labor relations with employers will be included in the basic old-age insurance and basic medical insurance for urban workers. Study and improve the policy of flexible employment of migrant workers to participate in the basic old-age insurance, and flexible employment of migrant workers can participate in the basic medical insurance for local urban workers or residents. Efforts will be made to realize that all migrant workers in employers participate in work-related injury insurance, and efforts will be made to solve the problem of ensuring the treatment of migrant workers in uninsured employers. Promote migrant workers to participate in unemployment insurance and maternity insurance and enjoy equal treatment. If the labor dispatch unit or the employing unit infringes upon the social insurance rights and interests of the dispatched migrant workers, joint liability shall be investigated according to law. Improve the policy of transferring and continuing social insurance relations. Integrate various social insurance management resources, optimize business processes, and enhance the social insurance service ability for migrant workers. (twelve) to strengthen the safety production and occupational safety and health protection of migrant workers. Constantly establish and improve the supervision and management mechanism of production safety, and fully implement the main responsibility of employers for production safety and occupational disease prevention and control. Strengthen the safety production and occupational health education and training of migrant workers in high-risk industries and small enterprises such as mines and engineering construction, and incorporate the knowledge about safety production and occupational health into vocational skills education and training. Strictly implement the system of holding certificates for special types of work and the system of combining safety production training, issuing work-related injury insurance premium payment certificate and enterprise safety production license audit. Supervise enterprises to carry out occupational health examination for migrant workers exposed to occupational hazards and establish monitoring files. Focus on rectifying the problem of frequent work-related injuries of migrant workers in mines, engineering construction and other fields. Establish key occupational disease monitoring posts and implement occupational disease prevention and assistance actions for migrant workers. Promote the construction of technical service system for occupational disease prevention and control, and improve the system of linking the relevant work procedures of occupational disease diagnosis, treatment and appraisal with the work-related injury identification, labor ability appraisal and compensation mechanism. (thirteen) to protect the legitimate rights and interests of migrant workers in rural areas. Protect migrant workers’ rural land contractual management rights, homestead use rights and collective economic income distribution rights according to law. We will conscientiously do a good job in the registration and certification of rural land contractual management rights, forest rights, homestead use rights and farm house ownership, and effectively clarify the rural land contractual management rights, forest rights, homestead use rights and farm house ownership of migrant workers. Establish and improve the land contractual management right transfer market, standardize the transfer management services, and ensure that migrant workers share the land value-added income fairly according to law. Improve the mediation and arbitration system and mediation mechanism of land contract management disputes. Deepen the reform of rural collective property rights system, explore various effective forms of rural collective economy, and protect the rights of members of migrant workers’ collective economic organizations. In accordance with relevant laws, regulations and policies, properly handle the issues of land contractual management rights, forest rights, homestead use rights and collective economic income distribution rights after migrant workers and their accompanying families settle in cities. (fourteen) to further smooth the channels of migrant workers’ rights protection. We will comprehensively promote the grid and network management of labor security supervision, and investigate and deal with illegal acts of employers that infringe on the legitimate rights and interests of migrant workers according to law. We will improve the mediation mechanism of migrant workers’ labor disputes, which encourages reconciliation, strengthens mediation, arbitrates according to law, and connects litigation, further unblock the "green channel" of migrant workers’ labor disputes arbitration, bring migrant workers’ labor disputes into the scope of people’s mediation, and quickly mediate migrant workers’ labor disputes according to law. Establish and improve the system of pre-execution of project payment disputes involving migrant workers’ wage rights and interests, and improve the summary procedure system for migrant workers’ wage rights and interests disputes. Innovate the service mechanism of rights protection of grass-roots trade unions, and give full play to the important role of trade unions in listening to the reasonable demands of migrant workers and safeguarding their legitimate rights and interests. Vigorously promote the establishment of labor dispute mediation organizations by chambers of commerce (associations) and further strengthen the construction of labor dispute mediation organizations in enterprises. Further strengthen the grassroots law enforcement forces of labor security, standardize labor and personnel dispute arbitration courts and build grassroots labor dispute mediation organizations, and effectively enhance the ability to safeguard the rights and interests of migrant workers.(led by the Provincial Department of Human Resources and Social Security; Provincial Industry and Information Technology Commission, Public Security Department, Justice Department, Provincial Court, Provincial Federation of Trade Unions, etc. are responsible for the division of responsibilities)

(fifteen) to strengthen legal services and legal aid for migrant workers. Improve and perfect the grassroots legal aid and legal service network, encourage relevant organizations to set up specialized legal aid institutions for migrant workers, and include labor disputes, forest rights disputes, land contracting, land acquisition and demolition and other matters into the scope of legal aid. Strengthen the work of legal aid, simplify the examination procedures for accepting legal aid applications, lower the threshold, and enable eligible migrant workers to obtain legal aid in a timely and convenient manner. Improve the cooperation mechanism in different places to facilitate migrant workers to apply for legal aid in different places. Open the legal service hotline for migrant workers, increase the intensity of popularizing law, continuously improve the legal awareness and legal quality of migrant workers and employers, and guide migrant workers to legally and rationally safeguard their rights.(led by the Provincial Department of Justice; Provincial Department of Human Resources and Social Security, Department of Finance, Provincial Court, Provincial Federation of Trade Unions, etc. are responsible for the division of responsibilities)

Four, promote the equal enjoyment of urban basic public services by migrant workers.

(sixteen) gradually promote the equal enjoyment of urban basic public services by migrant workers. We will deepen the reform of the basic public service supply system and steadily promote the full coverage of the permanent population of urban basic public services. All localities and relevant departments should gradually allocate basic public service resources according to the permanent population, clarify the basic public service projects that migrant workers and their families can enjoy, and continuously improve the comprehensive carrying capacity and expand the scope of the project. Promote the decoupling of public service rights from household registration, and gradually realize the equal enjoyment of civil rights by migrant workers and their families. Migrant workers and their accompanying families who have not settled in the towns where they are imported shall apply for a residence permit according to law and enjoy the basic public services provided for by the residence permit. In cities where migrant workers are relatively concentrated, relying on service platforms such as township (street), community residents’ service and social security for employment, a "comprehensive service center for migrant workers" will be built to provide convenient, efficient and high-quality "one-stop" comprehensive services for migrant workers.(led by the Provincial Department of Human Resources and Social Security; Provincial Development and Reform Commission, Education Department, Public Security Department, Civil Affairs Department, Finance Department, Housing and Urban-Rural Construction Department, Culture Department, Health and Family Planning Commission, etc. are responsible for the division of responsibilities)

(seventeen) to protect the children of migrant workers’ equal right to receive education. The government of the migrant workers’ importing area should incorporate the education of migrant workers’ children into the local education development plan, rationally plan the school layout, scientifically verify the staffing of public schools, increase the investment in public schools, establish a mechanism for accepting the education investment of migrant workers’ children in the importing area, and ensure the equal right of migrant workers’ children to receive compulsory education in the employment place. Coordinate the balanced allocation of compulsory education resources in urban and rural areas, and gradually increase the proportion of migrant children recruited by public schools and quality schools. Public compulsory education schools should be generally open to migrant children of migrant workers, mixed with urban household registration students, and unified management. The children of migrant workers who have entered the compulsory education stage in cities and towns enjoy the same "free subsidy" policy as local students. Actively create conditions to meet the needs of migrant children of migrant workers to receive inclusive preschool education as much as possible. For those who receive compulsory education and preschool education in public welfare private schools and inclusive private kindergartens, the government will purchase services and other ways to implement support funds to guide and help schools and kindergartens improve the quality of education. Further improve and perfect the policies and measures for eligible migrant workers’ children to take the entrance examination in Yunnan after they are promoted to junior high school and receive compulsory education. Carry out activities to care for migrant children. (eighteen) to strengthen the medical and health care and family planning services for migrant workers. We will continue to implement the national immunization program to ensure that migrant workers’ school-age children enjoy equal access to vaccination services. According to the resident population, urban basic medical and health care and family planning service resources will be allocated, the community health and family planning service network will be improved, migrant workers and their accompanying families will be included in the community health and family planning service system, and basic public health services such as health education, maternal and child health care, vaccination, prevention and control of infectious diseases and family planning will be provided free of charge. Strengthen disease monitoring, epidemic situation handling and public health emergencies in migrant workers’ settlements, and implement relevant policies for free treatment and assistance. Do a good job in AIDS prevention publicity and education for migrant workers, and implement policies such as "four exemptions and one care" for AIDS prevention and treatment. Encourage qualified areas to include eligible migrant workers and their accompanying families in the scope of local medical assistance. Consolidate and improve the "one chess game" working mechanism of family planning service management for floating population, strengthen the assessment, and implement the responsibility of migrant workers’ input and output. (nineteen) gradually improve the living conditions of migrant workers. Overall planning of urban resident population size and construction land area, will solve the housing problem of migrant workers into the housing development plan. Support to increase the supply of small and medium-sized ordinary commercial housing, standardize the housing rental market, actively support qualified migrant workers to buy or rent commercial housing, and enjoy preferential policies such as deed tax and stamp duty in accordance with regulations. Improve and perfect the housing security system in our province, bring eligible migrant workers into the implementation scope of urban affordable housing, and extend the construction of urban affordable housing to towns and villages. Strengthen environmental improvement and comprehensive management services in villages in cities and shanty towns, so as to improve the accommodation conditions of migrant workers living in them. Support qualified enterprises and build public rental housing in the way of "co-construction of government and enterprises". Enterprises with a large number of migrant workers are allowed to build collective dormitories for migrant workers within the scope of land that meets the prescribed standards. Explore the construction of unit-type or dormitory-type public rental housing in development zones and industrial parks in accordance with the principle of economical and intensive land use, and rent it to migrant workers. (twenty) to promote the orderly settlement of migrant workers in cities and towns.
